Filing Worker's Compensation Claims Involves The Following Steps:
1. Report the Injury Immediately:
Notify your employer about the injury as soon as possible. Many states have strict deadlines, so prompt reporting helps ensure your claim is valid.
2. Seek Medical Attention:
Get medical treatment right away. Inform the healthcare provider that your injury is work-related so they can document it properly for your claim.
3. Complete a Workers’ Compensation Claim Form:
Your employer should provide you with the necessary claim form (often called a DWC-1 or similar). Fill it out accurately, detailing how the injury occurred, and submit it to your employer.
4. Employer Submits the Claim:
After receiving your completed form, your employer will submit it to their workers' compensation insurance carrier, along with any required documentation.
5. Follow Up with the Insurance Company:
The insurance company will review your claim, which may include investigating the incident, reviewing medical records, or requesting additional information.
6. Keep Records:
Maintain copies of all forms, medical reports, and communication related to your claim. This can help if any disputes arise later.
7. Comply with Medical Treatment and Requests:
Attend all medical appointments, follow treatment plans, and cooperate with any requests from the insurance company, such as independent medical evaluations if required.
8. Receive a Decision:
The insurance company will approve or deny your claim. If approved, you’ll start receiving benefits. If denied, you have the right to appeal the decision through your state’s workers' compensation board.
In all workers compensation cases, the patient’s claim must be “verified” with the insurance carrier prior to treatment being rendered.
